    Bulk E-mail and Other Prohibited E-mail

    The Direct Auto Insurance computer network (which includes, but is not limited to, the technology and applications which support the e-mail functionality Direct Auto Insurance provides its officers, employees, independent contractor agents, and other authorized users) is the private property of Direct Auto Insurance.

    Direct Auto Insurance prohibits any bulk e-mail transmissions to be sent, or caused to be sent, over the Internet to directauto.com e-mail addresses unless Direct Auto Insurance, through one of its officers, has specifically requested or authorized the sending of such bulk e-mail. For purposes of these Terms of Use, the word "bulk" shall mean an e-mail message, or group of identical or similar e-mail messages, sent to more than 20 different directauto.com addresses in any 24-hour period.

    Direct Auto Insurance also prohibits any e-mail transmissions of the following types to be sent, or caused to be sent, over the Internet to more than 5 different directauto.com e-mail addresses in any 24-hour period unless Direct Auto Insurance, through one of its officers, has authorized the sending of such e-mail: (1) commercial advertising; (2) informational announcements; (3) political or religious tracts; or (4) solicitations for funds or donations.

    Direct Auto Insurance prohibits any e-mail transmission to be sent, or caused to be sent, over the Internet to any directauto.com e-mail addresses if the e-mail is intended to, or appears intended to, harass, embarrass, threaten, defame or impersonate any person, or if the e-mail is pornographic, offensive, indecent, discriminatory or offensive on the basis of sex, color, national origin, race, age, religion, sexual orientation or disability.

    Direct Auto Insurance prohibits any e-mail transmission to be sent, or caused to be sent, over the Internet to any directauto.com e-mail address that makes use of a forged header or deceptive addressing, or which attempts in any manner to disguise the source of the e-mail.

    Direct Auto Insurance prohibits the harvesting or collection of the e-mail addresses of Direct Auto Insurance agents and/or personal financial representatives from the directauto.com web site for the purpose of sending bulk e-mail to directauto.com e-mail addresses.

    Direct Auto Insurance reserves the right to take all legal and technical steps available, including pursuing civil remedies and criminal prosecution, to prevent bulk or other prohibited e-mail from entering, utilizing or remaining within the Direct Auto Insurance computer network.

    Nothing in this policy is intended to grant any right to transmit or send e-mail to, or through, the Direct Auto Insurance computer network. Direct Auto Insurance's failure to enforce this policy in every instance in which it might have application does not amount to a waiver of Direct Auto Insurance's rights.

    Online Registration/Application Process and Representations

    If you apply for insurance through our website, you represent and warrant that:

    • You are the individual applying for and seeking insurance coverage under our Site or otherwise accessing our Site, and that you are not using our Site for unauthorized or unlawful use.
    • You have fully and accurately disclosed all material information we require, such as: your address, family members who live with you, all regular or frequent operators of any vehicle(s) you ask us to insure and whether they are used for any business or commercial purpose; your type of residence, etc.

    You also agree to notify us immediately at any time that information ceases to be true, complete and accurate and understand that coverage may be terminated or declared void from inception or claims may be denied due to any misrepresentations, omissions, or inaccuracies stated by you. 

    Consent to Electronic (“Paperless”) Communication and Electronic Signature

    As used in this Consent, the prospective policyholder or policyholder is referred to as “you”, “your” or “Policyholder.”  Direct Auto Insurance and its insurance company affiliates in the National General Group are referred to individually and collectively as “Direct Auto Insurance”, “we”, “us”, or “our”.

    In order to apply for or purchase an insurance policy or other product through our website, you must agree to (i) completing and signing your application(s) and related forms electronically and (ii) receive electronic communications from us. This consent applies to any transaction you enter into with us or any of our affiliates in the National General Group through our websites.

    1. Electronic Communications: If you are electing or have elected to receive documents from us in electronic form, you agree as follows:
    2. Required Technology. In order to access, download and retain electronic communications/documents, you must have a valid and working email address and access to a personal computer or smart device with internet capability and the following: a compatible Internet Browser (e.g. Edge, Chrome, Firefox, DuckDuckGo, etc.) and Adobe Acrobat Reader (available for free at adobe.com). Your browser may be required to allow pop-up windows and it may also be necessary for you to enable "Cookies". You must have the ability to save electronic communications on your device(s) or to print out the electronic communications. We may require you to validate your email address. This consent to receive electronic communications applies to all transactions with, and products and services from Direct Auto Insurance that are initiated or applied for through the Direct Auto Insurance website. This includes without limitation communications and documents relating to an application for insurance and delivery of all relevant disclosures, statements, notices, policies, declaration pages, endorsements, agreements, and other forms (“Policy Documents”) that we are required to send to you. The parties intend the federal Electronic Signatures in Global and National Commerce (E-SIGN) Act to apply to the fullest extent possible to validate the electronic transactions and communications of the parties.

Direct Auto Insurance may communicate with you electronically by (1) email to the most recent email address you have registered with us and (2) by a posting to the Direct Auto Insurance website that is accessed by you. All electronic communications from us to you will be considered “in writing.” Direct Auto Insurance may send a notice to your email address when it posts an electronic communication to the Direct Auto Insurance website. An electronic communication is delivered to you upon placing the communication on the Direct Auto Insurance website or upon emailing it to you. Please print or save for your records a copy of any electronic communication (including this Consent Page) that is important to you.
    5. Withdrawing Your Consent. You must agree to receive electronic communications in order to purchase a policy or other product produced by Direct Auto Insurance through our website. You may withdraw your consent to receive future electronic communications from us regarding a purchased insurance policy or other product by email at: Service@directauto.com or by calling our Customer Service (1-877-463-4732). You must confirm the physical address to which you want the paper copies sent. After a reasonable time to allow us to process your request, all copies of future Policy Documents will be delivered to you in paper form. Except where prohibited by law, we reserve the right to impose a transactional fee if you withdraw your consent to receive electronic communications from us.
    6. No Paper Copies. Except where required by law, Direct Auto Insurance is not required to send you paper copies of any electronic communications. However, we reserve the right in our discretion to send you a paper communication regarding your Direct Auto Insurance policy or product. You may request a paper copy of a communication relating to your Direct Auto Insurance policy or other Direct Auto Insurance product or service by contacting Direct Auto Insurance Customer Service. Except where prohibited by law, Direct Auto Insurance may impose a fee for providing you with a paper copy at your request.
    7. Updating Contact Information. To update your email address or other contact information for receipt of electronic communications, or to withdraw your consent to receive electronic communications, please use the “MyAccount” feature on the Direct Auto Insurance website or contact our Customer Service. You must notify us immediately at Service@directauto.com or 1-877-463-4732 if you change your email address or other location to which your policy documents are to be delivered.

    If at any point you have questions regarding Electronic Delivery please contact us by any of the methods described above.

    1. Electronic Signature and Use of Electronic Documents: If you elect to complete and/or electronically sign your application or any other related document on this Site (“electronic document”), you agree as follows:

    By completing an electronic application or other form on this Site, you agree that, for purposes of complying with any applicable law that requires a "writing," such electronic document shall be considered to be "in writing" or "written" to the same extent as if it were in paper form. You and we intend the federal Electronic Signatures in Global and National Commerce (E-SIGN) Act to apply to the fullest extent possible to validate the electronic transactions and communications of the parties.

    We may deny access or block any transaction made under your password without prior notice if we believe your password is being used by someone other than you, or if any unauthorized access to your personal information has occurred or may occur, or for any other reason, but we are under no obligation to do so.

    Mobile Messaging and Email

    If you have agreed to receive communications from us via your mobile device or email, you agree that you will be responsible for updating your contact information if it changes and for any fees your wireless service provider charges you for sending and receiving text/data messages. We also do not assume any liability for any losses or damage (a) caused by the disclosure of information to your mobile phone when the phone is another person's possession; or (b) to your data, mobile device, or other equipment unless the damage is directly and solely caused by our gross negligence or willful default. You agree to indemnify, defend and hold us harmless from and against any claims, losses or costs (including reasonable attorneys' fees) if you provided us with a phone number that is not your own or if you violate any applicable state and federal laws and regulations. Remember, you can revoke your consent to receiving email and text messages at any time by notifying us in writing.

    Timely Payment

    If you are a policyholder with us, you understand and agree that if we do not receive proper and timely payment or if your financial institution does not honor/authorize the payment you may not receive insurance coverage. Any dishonored payments may incur an insufficient funds fee. If we do not receive your payment of the invoiced amount by the payment due date, we may charge you a late fee. Any late payments may result in the cancellation of your insurance policy. Cancellation of a policy before the term expiration date may incur a cancellation fee.

    If you choose to make payments by electronic funds transfer, you agree to provide accurate information allowing for the processing of such payments and agree to electronic authorization of such payments.
     
    Applicable Law

    These Terms of Use, as well as the use of our Site, is governed in all respects by the laws of the State of North Carolina without giving effect to any principles of conflict of laws. Any dispute concerning this Agreement, or our Site, shall be subject to the exclusive venue of a court of competent jurisdiction in the state of North Carolina.
     
    Severability

    If any provision in these Terms of Use is held to be invalid, void, or for any reason unenforceable, that provision shall be deemed severable from and shall not affect the validity and enforceability of the remaining provisions and the remaining provisions shall remain in full force and effect.
